Welcome to Kwick Products (including our brands Kwick Graab, Kwick Kook, and Kwick Nutri, collectively referred to as “Company”, “we”, “our”, “us”). By accessing our website, creating an account, or purchasing our food products, meal kits, or nutritional items, you agree to comply with and be bound by these Terms & Conditions (“Terms”). If you do not agree with these Terms, please do not use our website or services.

1. Use of Website & Account Creation

You agree to use this website only for lawful purposes.

  • Account Responsibility: If you create an account to purchase products, you are responsible for maintaining the confidentiality of your login credentials and restricting unauthorized access to your account.
  • Prohibited Conduct: You must not introduce malicious software (such as viruses, trojans, or harmful code), attempt unauthorized access to our networks, or use automated scraping tools or bots to pull product descriptions, pricing, or images from our platform.
  • Termination: We reserve the right to suspend or terminate accounts, refuse service, or cancel orders at our sole discretion if fraudulent activity, payment defaults, or policy violations are detected.

2. Commercial Terms: Orders, Pricing, & Payments

  • Order Acceptance: Your receipt of an electronic order confirmation does not signify our final acceptance of your order. We reserve the right to accept, decline, or limit your order quantity for any reason, including stock unavailability, regional delivery restrictions, or pricing errors.
  • Pricing & Accuracy: We strive to ensure all pricing and descriptions are accurate. If a food item or meal kit is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel any orders placed for that item, even if the order has been confirmed and your payment processed. If canceled, a full refund will be issued to your original payment method.
  • Secure Payments: Payments are processed securely via authorized third-party payment gateways. We do not store financial card data. You agree to provide current, complete, and accurate purchase and account information for all transactions.
  • Subscription Plans & Auto-Renewal: If you subscribe to a recurring delivery plan (e.g., weekly meal kits or monthly snack boxes), your payment method will be charged automatically at the start of each billing cycle. In compliance with Reserve Bank of India (RBI) guidelines, you will receive a pre-debit notification prior to the transaction. You can cancel or pause your subscription at any time through your account dashboard at least 48 hours before the next scheduled dispatch.

3. Food Shipping, Perishability, & Delivery

  • Perishable Goods (Kwick Graab, Kwick Kook & Kwick Nutri): Many of our products include fresh ingredients, prepped meal kits, and perishable snacks. It is your responsibility to ensure that an authorized person is available to receive the delivery at the shipping address provided.
  • Storage Post-Delivery: Upon delivery, the responsibility for maintaining appropriate storage conditions (e.g., immediate refrigeration of fresh ingredients or meal kits) shifts entirely to you. We are not liable for food spoilage, contamination, or degradation resulting from improper storage after delivery execution.
  • Logistics Failures: We partner with third-party logistics and courier networks to deliver our products. While we aim for prompt delivery, we are not liable for delayed arrivals caused by factors beyond our control, such as severe weather, traffic disruptions, or inaccurate customer address data.

4. Cancellations, Returns, & Refunds

  • Fresh Food Policy: Due to the perishable and consumable nature of our food products, meal kits, and nutritional snacks, we do not accept returns or offer exchanges on food items once they have been dispatched.
  • Damaged or Missing Items: If you receive a physically damaged product, an incorrect order, or find critical items missing from your meal kit, you must notify us at connect@kwickproducts.com within 24 hours of delivery. Please include your order number and clear photographic evidence of the damage or discrepancy. Eligible complaints will be resolved via a replacement or store credit at our sole discretion.
  • Order Cancellation: Orders for fresh or customized meal kits cannot be canceled or modified once they have entered the preparation or fulfillment stage.

5. Health, Allergy, FSSAI, & Dietary Disclaimer

  • FSSAI Compliance: Kwick Products and its associated brands operate under valid licenses issued by the Food Safety and Standards Authority of India (FSSAI). Our operations are registered under FSSAI License No. 11525998000701.
  • Allergen Notice: Our meal kits and nutritional products are processed in facilities that handle common allergens (including but not limited to nuts, wheat, dairy, soy, and gluten). While we make efforts to label specific allergens on Kwick Kook and Kwick Nutri packaging, cross-contamination is always possible. If you have severe food allergies, you consume our products at your own risk.
  • Nutritional Information: Any health, fitness, or nutritional insights provided on our website, blogs, or packaging are for informational purposes only. They do not constitute professional medical or dietary advice.

6. Intellectual Property

All content displayed on this website—including text, graphics, logos, brand names of Kwick Products (Kwick Graab, Kwick Kook & Kwick Nutri), product descriptions, cooking instructions, images, custom recipes, and software—is the exclusive property of Kwick Products or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, modify, or commercially exploit any content without our prior written permission.

8. Limitation of Liability & Disclaimer

  • "As Is" Basis: The website, digital services, and all products are provided on an “as is” and “as available” basis without express or implied warranties, including implied warranties of merchantability or fitness for a particular cooking, health, or dietary purpose.
  • Liability Cap: To the fullest extent permitted by applicable law, Kwick Products and its directors or affiliates shall not be liable for any indirect, incidental, or consequential damages (including foodborne illness arising from improper customer storage, handling, or cooking of meal kits). Our total liability for any claim arising from a product purchase shall not exceed the actual price paid by you for that specific product order.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kwick Products, its directors, employees, and logistics partners from any third-party claims, damages, losses, liabilities, or expenses (including legal fees) arising from your misuse of the website, violation of these Terms, or failure to properly handle, store, or cook perishable ingredients.

10. International Use & Children's Privacy

Our platform and operations are primarily designed and compliant under the laws of India. If accessed internationally, you acknowledge that your information is transferred to India and assume all cross-border legal compliance risks. Furthermore, our products are intended for purchase by adults; users under the legal age must have parental or legal guardian consent to transact.

11. Governing Law & Dispute Resolution

These Terms shall be governed by, interpreted, and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, product issues, or online transactions shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, India.
